LDP lawyers complain over alleged poll violations |

LAWYERS of the Laban ng Demokratikong Pilipino (LDP) have formally lodged a complaint with the officer in charge of the Western Mindanao State University for the "unlawful display and posting of election propaganda materials" of a congressional candidate inside the WMSU premises.
At the same time, lawyers Jose Saavedra and Evangeline Doctolero complained of the utilization of WMSU's radio hour every Saturday from 8:30-9:00 a.m. because it "directly favors or promotes the candidacy of certain candidates in the forthcoming elections or otherwise engages in partisan political activity."
The propaganda materials posted and displayed inside the WMSU campus are those of Eldigario Gonzales, former WMSU president.
Saavedra and Doctolero, attached in their formal complaint dated May 8 and filed before Dr. Ofelio Mendoza, WMSU officer-in-charge, photographs of the election propaganda materials displayed and a cassette tape of the radio program.
Specifically, the LDP lawyers said the acts referred in the complaint are violation of section 9 of Republic Act No. 9006 otherwise known as the Fair Elections Act and section 261, paragraphs (1) and (o) in relation to section 263 and section 264 of Batas Pambansa Bilang 881 otherwise known as the Omnibus Election Code of the Philippine4s and section 23 and 11 of Comelec resolution 7767 promulgated on Nov. 30, 2006.
The two lawyers urged the WMSU OIC to "order the immediate removal of all election propaganda materials displayed within the premises of the institution and to immediately cease and desist from further devoting WMSU hour."
These acts, they said, unduly enhance or promote the candidacy of a certain candidate at the expense of government funds and the use of the name of the state university.
Comelec resolution 7767 provides that any violation of Republic Act 9006 constitutes an election offense punishable under the law in addition to administrative liability.
Copies of the complaint were furnished to the City election officers of both Districts I and II and the Regional director of the Commission on Elections. (SE)
